Bodhi Advocates provides specialised legal services relating to pension matters in Thailand. Our current service offerings are:

Pension Document Assessment — ฿4,400

A careful review of a client's pension documentation to identify matters requiring attention, accompanied by a written summary in plain terms.

Representation in Pension Disputes — ฿10,000

Legal support in contested pension matters, including case preparation, correspondence, and representation in negotiations or hearings.

Long-Term Pension Stewardship — ฿17,200

An ongoing engagement providing full case oversight, liaison with funds and authorities, formal representation, and regular reviews with a consistent point of contact.

Our Services are primarily offered to clients based in Thailand. We reserve the right to decline to act where a matter falls outside our practice areas or where we are unable to act due to conflicts of interest or other professional obligations.

4. User Responsibilities

4.1 Acceptable Use of this Website

You agree to use this Website only for lawful purposes and in a manner that does not infringe the rights of, or restrict or inhibit the use of this Website by, any third party.

4.2 Prohibited Activities

You must not:

  • Use this Website for any unlawful purpose or in breach of applicable Thai law;

6. Payment Terms

6.1 Fees

Our service fees are denominated in Thai Baht (THB). The fees applicable at the time of engagement are as stated in our current service schedule and any agreed engagement letter. We reserve the right to update our fees and will communicate any changes before they take effect.

6.2 Payment

Payment arrangements, including timing and method, are set out in the engagement letter applicable to your matter. We will not commence substantive work until payment arrangements have been confirmed in writing.

6.3 Refund Policy

If you cancel an engagement before substantive work has commenced, we will refund any fees paid in full. If cancellation occurs after work has begun, we will calculate a fair fee for work completed and refund the balance, if any. We will discuss this with you openly and without dispute.

7. Service-Specific Terms

7.1 Scope of Engagement

The scope of each service engagement will be confirmed in an engagement letter before work commences. Work falling outside the agreed scope may be the subject of a separate fee arrangement.

7.2 Client Cooperation

The effective delivery of our Services depends on your timely provision of relevant documents and information. Delays caused by a failure to provide requested materials may affect the timeline of the matter and are outside our control.

7.3 Timelines

We will set out our best assessment of likely timelines when we take on a matter. Legal proceedings and regulatory processes can be unpredictable; any timelines we communicate are estimates and not binding commitments.

7.4 Changes to Scope

Where the nature or complexity of a matter changes materially after the engagement commences, we will discuss any implications for scope and fees with you before proceeding with additional work.

8. Confidentiality

We treat all information shared with us in connection with your matter as confidential. We will not disclose it to any third party except where required by law, by a court or regulatory authority, or where you have given your prior written consent.

Professional legal privilege may apply to communications between you and us. We will advise you when we believe this is relevant and take appropriate care to protect any privileged communications.

9. Disclaimers

9.1 Website Content

You agree to indemnify and hold harmless Bodhi Advocates and its practitioners from any claims, losses, damages, or costs (including reasonable legal fees) arising from your breach of these Terms, your misuse of this Website, or any false or inaccurate information you have provided to us.

12. Termination

12.1 Termination by You

You may terminate a service engagement at any time by written notice to us. You will remain responsible for fees for work completed up to the point of termination, as set out in Section 6.3.

12.2 Termination by Us

We may terminate or suspend an engagement where we are required to do so by law or professional rules, where a conflict of interest arises, or where you have materially breached these Terms or the terms of an engagement letter. We will provide reasonable written notice where circumstances allow.

12.3 Effect of Termination

On termination, all confidentiality obligations and any provisions that by nature should survive will continue in force. We will return or securely delete your documents in accordance with applicable law and our privacy policy.

13. Dispute Resolution and Governing Law

13.1 Governing Law

These Terms and any dispute arising from them are governed by the laws of the Kingdom of Thailand, including the Civil and Commercial Code of Thailand and the Consumer Protection Act B.E. 2522 (1979) as applicable.

13.2 Jurisdiction

Any dispute that cannot be resolved informally will be subject to the exclusive jurisdiction of the courts of Bangkok, Thailand.

13.3 Informal Resolution

Before commencing any formal proceedings, both parties agree to attempt to resolve any dispute in good faith through direct discussion. If you have a concern about our Services, please write to us at [email protected] in the first instance.

14. General Provisions

14.1 Entire Agreement

These Terms, together with any applicable engagement letter, constitute the entire agreement between us in respect of your use of the Website and the provision of Services, and supersede any prior representations or understandings.

If any provision of these Terms is found to be unenforceable, it will be modified to the minimum extent necessary to make it enforceable, or removed if modification is not possible, without affecting the validity of the remaining provisions.

14.3 Waiver

Our failure to exercise or enforce any right or provision of these Terms on any occasion does not constitute a waiver of that right or provision on future occasions.

14.4 Assignment

You may not assign or transfer any rights or obligations under these Terms without our prior written consent. We may transfer our rights and obligations to another entity in connection with a restructure or business continuity arrangement, in which case we will notify you in writing.

14.5 Notices

15. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last Updated" date at the top of this page. For matters already subject to a formal engagement letter, existing terms will apply unless we notify you of changes and you agree to them in writing.

For general website use, continued access to the Website following an update to these Terms constitutes your acceptance of the revised Terms. If you do not accept the revised Terms, please discontinue use of the Website.
